Conditions

Conditions Applying To Applications
A condition of acceptance of an application is that the Foundation reserves the right to seek advice from outside experts regarding the merits of any particular application, or to refer an application to other funding bodies for the purpose of seeking supplementary funding. (Refer to the Foundation's policy in respect of the Privacy Act).

Standard Conditions Attaching To Grants
The Foundation has a responsibility to assure itself that grants are effective. Grants will be closely monitored and, where appropriate, audited. When a grant is approved the applicant will be required to sign the Foundation's standard Grant Terms when the grant is accepted. A copy of the standard Grant Terms can be downloaded from the Foundation's website or obtained from the Foundation office.

Other Policies

Copyright
The Foundation is a registered charity. It must ensure that works which comply with the charitable purposes described in its Trust Deed are made widely available within the community. For that purpose, it is important that any works which are produced as a result of funding from the Foundation will be readily available to the public without any selective distribution or exploitative pricing. Applicants will be required to state:

  1. What the anticipated product of a funded project would be, i.e. a book, article, video, film, software, etc.
  2. How the work will be disseminated to the public.
  3. The means by which the applicant can ensure that the work will be made available at a reasonable price and without any restrictive actions by a copyright owner.

Notwithstanding any provisions of the Copyright Act which might cause the presumptive vesting of copyright in a funded work in the Foundation, the Foundation does not wish to acquire copyright in any funded work and it would be a condition of any grant that none of the statutory presumptions which might cause copyright in a funded work to vest in the Foundation, will prevail.

However, the following conditions will apply:

Further, it will be a condition of any grant that if the Foundation concludes, on reasonable grounds, that in contravention of assurances which have been made about the ability of the recipient to ensure that there will be no selective distribution or excessive pricing of a funded work, there has been a breach of the provision, the recipient can be required to repay any grant(s) received.

Privacy Act Implications
In some instances enquiries may be made in relation to applications which might require disclosure of information contained in those applications. If there is any information contained in your application which is particularly confidential please to let us know and we will ensure it is treated accordingly.

In accordance with the Privacy Act 1993.
