| TERMS OF REFERENCE | |

1. |
Eligibility |
| 1.1 | The fellowship is available to persons who have demonstrated high ability in their chosen field, and the ability to carry out the nominated research. |
| 1.2 | Eligibility is not confined to members of any one profession or occupation. The fellowship is open to academics, judges, government officials, legal practitioners and other persons with the required abilities. |
| 1.3 | Applicants must be either New Zealand citizens or ordinarily resident in this country, and must show a clear intention to remain resident in, or to return to, New Zealand at the end of the fellowship. |
| 1.4 | The fellowship is not available to fund any period of study toward a post-graduate qualification in New Zealand or overseas. |

|
Note: It is envisaged that the fellowship will be attractive to persons who wish to take a period of leave from their employment to enable them to pursue a research interest. |

2. |
The Research |
| 2.1 | The subject matter to be researched in the course of the fellowship must be of substantial public importance, and should be of such significance that the results of the research might be expected to lead to reform or betterment of the laws of New Zealand. |
| 2.2 | The findings of the research must be published in a book, or monograph, or article in a reputable journal. The publication must be in a form which enables the Law Foundation as the primary sponsor to be suitably acknowledged. |
| 3. | Tenure |
| 3.1 | The term of the fellowship will be a period of between 3 months and 1 year. |
| 3.2 | The fellowship may be held in New Zealand or overseas. |
| 4. | Emolument |
| 4.1 | The amount payable under the fellowship will not exceed $125,000. |
| 4.2 | The amount awarded will normally include: |
|
a. any reasonable travel expenses of the fellow (but normally not of members of the fellow's family), |
|
| b. a reasonable living allowance, and | |
| c. other reasonable expenses associated with the research. | |
| 4.3 | In determining the amount the Foundation will take into account: |
| a. the length of the term of the fellowship, and | |
|
b. any other funding available to the fellow. |
|
| 5. | Frequency |
| 5.1 | Applications will be considered once a year. |
| 5.2 | More than one award may be made in any one year. |
| 5.3 | The Foundation reserves the right not to make any award in a particular year if it considers that there is no application of sufficient merit. |
| 6. | Applications |
| 6.1 | Applications must reach the Foundation office prior to 5pm on 1st September in each year. Applications must be made in writing to the Executive Director of the New Zealand Law Foundation. An application cover sheet must accompany the application and can be obtained from the Foundation's website at www.lawfoundation.org.nz/apply/forms.php . Applications will be accepted by email. |
| 6.2 | Applications must include the following: |
| a. a research plan which explains the exact nature of the enquiry to be undertaken, | |
| b. a statement of the places where the research is to be undertaken, | |
| c. a complete budget, | |
| d. the names of at least two appropriately qualified persons who will forward directly to the Foundation by 1 September a written assessment of the relevance and importance of the proposed research, the ability of the applicant to undertake it, and the suitability of the applicant for the fellowship, | |
| e. commencement and completion dates, and | |
|
f. particulars of any additional sources of funding. |

| 6.3 | Applications will be considered by a selection panel appointed by the Foundation. The panel will report to the Foundation, which has the final responsibility for making or declining an award. |
| 7. | Publicity |
| 7.1 | The Foundation alone has the right to announce the award of a fellowship. |
| 7.2 | Any publication of the results of research undertaken during the tenure of the fellowship must acknowledge the New Zealand Law Foundation as the donor of the grant which led to the research report. That acknowledgement must be in a form which has been approved by the Foundation. |
| 7.3 | The recipient of the fellowship will not be entitled to obtain private pecuniary gain from the publication of the report without the prior written permission of the Foundation. |
| 8. | Review |
| 8.1 | The fellow must provide a written progress report to the Foundation every three months during the continuation of the fellowship. |
| 8.2 | The Foundation may at any time modify the conditions on which the fellowship has been awarded, including the term of the fellowship. |
| 8.3 | If the Foundation is satisfied the fellow is failing to make adequate progress on the research it may terminate the fellowship and withdraw the funding. |
