NZ Law Foundation Launches Major Research Project on Regulatory Reform

The NZ Law Foundation is calling for expressions of interest from individuals and organisations interested in being funded (in whole or in part) to undertake a major research project on Regulatory Reform for New Zealand.

Consultation has been undertaken with commercial lawyers, government officials and academics and the Foundation has been given clear direction that research into aspects of regulatory reform is needed.

The Law Foundation sees 'regulatory reform' as an umbrella title under which more specific sub-topics could be explored, and has decided to leave it open to those submitting proposals to propose sub-topics of their own within the general area.  It is conceivable that the project could end up producing research outputs on a number of separate, but interrelated, topics.  Some issues identified as possible candidates for research are:

  • The role and utility of disclosure/information provisions;
  • Review of effectiveness of imported statutory regimes;
  • Protection of property rights;
  • Insolvency tests;
  • Price control mechanisms and their effectiveness.

The Law Foundation will fund the successful proposal(s).  It may be necessary to run the project in stages over (at least) one or two years.  We see this project as leading the way in discussing issues that are of extreme importance to New Zealand. 

The project team formed to conduct the research is to be interdisciplinary.  It might well be based in a University, although that is not inevitable.  Ideally the successful project team should involve academics and practitioners; lawyers, economists and accountants.  It might involve collaboration between universities.  There would be advantages in collaborating with overseas organisations, particularly those based in Australia.
